India* was hit by a vehicle and suffered a fractured ankle. She also had a minor head injury and some psychological symptoms.
Initial challenges
She was treated in hospital but when ready to go home, she had to be supported by her family. We notified the insurers of India’s claim and got them to agree to the appointment of a case manager.
The case manager recommended benefits support, physiotherapy, neurology input, occupational therapy, pain management, and psychology support.
Other challenges in case
Unfortunately, the insurer was uncooperative, and they refused to fund the support recommended by the case manager. This is against the spirit of the rehabilitation code, which governs how the parties to a claim should engage in rehabilitation.
Outcome
However, we managed to get all the evidence needed to assess India’s claim and begin settlement negotiations. This resulted in agreeing a settlement of around £150,000, which would pay for her future treatment needs.
We also sorted financial advice for her, to invest the funds, that we also placed in a trust to protect any current or future entitlement to means tested benefits.
