William* was left with a serious head injury after a road traffic incident. He was taken to hospital where he needed an operation to remove part of the skull, to relieve pressure on the brain.
William’s initial challenges and our support
William, due to the brain injury, developed challenging behaviour and lacked insight into the injuries. He also could not remember the accident. After we were involved, we pressed for a case manager with experience of brain injuries to manage the rehabilitation. We got the driver’s insurers to fund the case manager to prepare an initial needs assessment, even though they disputed liability, and secured significant interim payments from them to help fund his rehabilitation needs. This included neuro-physiotherapy, neuro-psychotherapy, occupational therapy, and speech and language therapy.

As liability was initially disputed and only after the criminal proceedings did the insurer admit that their driver was negligent.
Outcome
In negotiations we secured a settlement offer of nearly £825,000. This settlement allowed William to move to a more suitable home; we handled the legal side of the house purchase for him. It also covered the costs of future treatment needs, so he now has a secure future.
