I am an associate in the property disputes team, having joined Higgs in September 2020. I have specialised in property litigation since qualifying as a solicitor in 2017.
Typically, I assist commercial landlord and tenant clients with disputes including lease renewals, rent arrears, dilapidations/disrepair, breach of covenant, insolvency, service charge and possession/forfeiture.
I assist residential landlord and tenant clients with disputes including rent arrears, disrepair, lease extensions and possession.
I also assist homeowner clients with matters such as boundary disputes, rights of way, adverse possession and restrictive covenants.
I am a member of the Property Litigation Association and Higgs’ community committee.
- Recovering possession of an inherited property for a client upon coming of age. A family member refused to vacate the premises on the unfounded assertion of a financial interest in the same. An Order for Possession and costs was successfully obtained and vacant possession secured.
- Advising a client on the termination clauses in various leases in anticipation of a relocation project. Subsequently serving various break notices for a number of properties resulting in the early termination of the client’s contractual lease obligations.
- Advising a landlord client on their rights and the procedure to terminate a lease following the tenant entering into a Creditors’ Voluntary Arrangement (CVA) which contained unfavourable terms. A Notice to Terminate was successfully served and the client was able to negotiate a new lease on more favourable terms.
- Advising a tenant client on their rights to security of tenure and the lease renewal process. Upon receipt the client was able to make the tactical decision to instigate the renewal process and eventually went on to agree terms for a new lease without the need for legal proceedings.
- Advising a client in respect of a restrictive covenant relating to a neighbour’s right of way over their property.
- Advising on a case where another law firm had negligently served a notice to terminate a tenancy. We served a subsequent notice resulting in the tenancy ending and negotiated a settlement in respect of the client’s losses suffered as a result of the law firm’s negligence.
- Advising a tenant client on their ability to sub-let under their existing lease having secured alternative premises. Assistance was provided throughout the formal subletting request procedure and a sublease was completed by a transactional solicitor in our commercial property team.
