Zahra Zafar
Associate - Property Litigation
"I am a property litigation lawyer with a special interest in assisting clients with dealing with property disputes, including disrepair claims, rights of ways, neighbour and boundary disputes, and possession claims.”
I am a solicitor in the property litigation team, having joined Higgs in August 2022 after training at a niche litigation firm.
I have experience in dealing with a range of commercial property disputes, including dilapidations, telecoms, possession/forfeiture and disputed lease renewals.
I also deal with residential property disputes, including possession claims, party wall disputes, restrictive covenants, rights of way and HMO disputes.
I am a member of the Birmingham Law Society and Property Litigation Association.
- I have acted for several residential landlords in successfully obtaining possession of their premises via the Section 8 and Section 21 procedures.
- I have assisted with two successful strike-out applications. The first related to a long-running boundary dispute where the other party had failed to comply with multiple court orders. The second application related to the other party issuing a second set of proceedings on similar facts to an earlier claim which had been previously struck out. Both claims were struck out, with cost orders in favour of our clients.
- I acted for a client who required access to their neighbour’s property to conduct maintenance works on their property. The neighbour refused to grant consent, so my client instructed me to assist. I effectively engaged with the neighbour and drew up an agreement permitting access, which set out the works that would be undertaken and the level of access required. The process was quick, and my client was able to carry out the necessary repair works, without having to resort to an application to the court for access rights, saving significant costs.
