Claire Whittall
Senior Associate - Court of Protection
"I am a private client lawyer with a special interest in Court of Protection matters, in particular assisting clients with additional needs to manage their property and financial affairs”
I am a senior associate in the Court of Protection Team, having joined Higgs LLP in 2015. Prior to joining Higgs LLP, I worked at another large regional law firm.
I deal specifically with matters where mental capacity is questioned and offer practical approaches to resolve any difficulties this may cause. I also deal with all applications to the Court of Protection.
I advise lay and professional deputies in making decisions for individuals who lack the mental capacity to do so themselves. I act with the individual’s best interests in mind and adopt a caring approach.
Further to this I advise clients on a range of other matters including wills, powers of attorney, advance directives (also known as living wills), care home fee planning and older client matters generally.
In addition, I work closely with our clinical negligence and personal injury teams, advising their clients on the merits of Personal Injury Trusts or Deputyship Orders following settlement of their case.
I am a member of The Association of Lifetime Lawyers and a Dementia Friend.
